Privacy policy

This Privacy Policy (“Policy”) sets out the rules for the use of the website dobrypieskarmy.pl and is intended to present the most important information on how personal data is processed in light of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (“GDPR”).

 

  1. General remarks and Administrator’s details

    Personal data that may be processed under this Policy are information about a natural person that make it possible to identify them through one or several specific factors determining their physical, economic or cultural identity, including the device IP address, location data, online identifier and information collected via cookies and other similar technologies. The main personal data processed by the Administrator include: first name and surname, email address, telephone number and the user’s residential or correspondence address.

    The Administrator of personal data in connection with the use of the website dobrypieskarmy.pl is SIGMA PETS sp. z o.o. with its registered office in Warsaw, ul. Ponczowa 27 (02-971 Warsaw), KRS: 0001174498, NIP: 9512622123 (“Administrator”).

  2. Purposes and legal bases for the processing of personal data

    The Administrator processes personal data on the basis of the GDPR, including on the basis of the necessity to perform a sales contract for products or to take steps at the request of the user prior to entering into such a contract (Article 6(1)(b) GDPR), on the basis of the user’s voluntary consent (Article 6(1)(a) GDPR) – for the purpose of conducting marketing activities of entities cooperating with the Administrator – or on the basis of the Administrator’s legitimate interests (Article 6(1)(f) GDPR).

    The Administrator processes personal data solely for the purpose of making the content collected on the website dobrypieskarmy.pl available to users, and also for the purpose of providing electronic services such as, in particular, direct marketing of its own products (e.g. in the form of a newsletter – if the Administrator offers such an option), concluding a sales contract for the products offered, preparing responses to a request for quotation, contacting the user and handling contracts concluded with the user (e.g. in the returns procedure).

    Personal data may also be processed for analytical and statistical purposes (analysing users’ activity and preferences). In some cases, the Administrator uses profiling of data. Through the automated processing of data, the Administrator assesses selected information relating to natural persons in order to analyse their behaviour or to create predictions of their future behaviour. Data may be transferred to entities processing them on behalf of the Administrator on the basis of agreements concluded with the Administrator, but only for the purposes and to the extent necessary to achieve the above-mentioned objectives, including, among others, entities providing IT services or other services to the Administrator that ensure the proper functioning of the website, provided that such entities process data solely in accordance with the Administrator’s instructions.

    Users’ personal data may be transferred to entities located in third countries, outside the European Economic Area, which nevertheless ensure an adequate level of protection of personal data in their territories.

    Providing accurate personal data by the user is a condition for concluding a sales contract for the products offered, under which the user is the buyer.

  3. Personal data storage period

    The Administrator processes personal data only for the period necessary to fulfil the purpose for which they are stored or for as long as required of the Administrator under the law, in particular until the limitation period for potential claims has expired or the obligation to archive arising from legal provisions has ceased, including the obligation to store accounting documents.

    In the case of processing personal data for the purpose of providing a newsletter service (if such a service is provided), personal data will be processed for the period necessary to provide this service, until the user unsubscribes. 

    In the case of processing personal data on the basis of consent, the data will be stored until such consent is withdrawn. The user can withdraw any consents given on the website at any time, including consent to the processing of data for marketing purposes of entities cooperating with the Administrator. Withdrawal of consent to data processing will not affect the lawfulness of processing carried out on the basis of consent before its withdrawal.

    In the case of processing data on the basis of the Administrator’s legitimate interests, the Administrator will cease processing the data earlier if the user effectively objects to such processing.

  4. General provisions concerning the processing of personal data

    The user has the following rights in connection with the processing of personal data:

    1. the right of access to personal data and to obtain information on their processing;
    2. the right to obtain a copy of personal data;
    3. the right to rectification of personal data;
    4. the right to erasure of personal data;
    5. the right to restriction of processing;
    6. the right to data portability;
    7. the right to object to the processing of personal data;
    8. the right to withdraw consent if data are processed on the basis of the user’s consent;
    9. the right to lodge a complaint with the President of the Personal Data Protection Office. 

    The rules for exercising the rights referred to above are set out in detail, in particular in Articles 16–22 of the GDPR. The user may always contact the Administrator to request information about the data held and the purposes for which they are processed.

  5. Cookies

    Cookies are small text files that are stored on a device when using the website dobrypieskarmy.pl. These files are sent by the website to the browser. Each cookie has an anonymous identifier and makes it possible to identify the device in whose memory it has been stored for a specific period of time (the time after which a given cookie will be deleted). Cookies are stored to recognise the device, learn about preferences and collect information on previous activity on the website.

    The most common types of cookies include:

    1. session cookies – information stored in the browser’s memory until the end of the session, i.e. until it is closed – necessary for some website functionalities to work properly;

    3. first-party cookies – stored by the website currently being visited and used to improve the quality of the use of the website;
    4. third-party cookies (third party Cookies) – used by third parties, such as social media platforms, in order to track visits to various websites where advertisements are placed.

    Cookies can be categorised as follows:

    1. necessary cookies – always active; without these files it is not possible to navigate the website or use its functionalities;
    2. performance cookies – collect information on how visitors use the website, e.g. which subpages are visited most frequently. These files are used to improve the functioning of the website. These files may be activated only with consent, expressed by clicking the relevant checkbox, which can be withdrawn at any time;
    3. functional cookies – store information about choices made by users, thanks to which the websites can offer improved and personalised functionalities. For example, this type of cookie may store information about tracking numbers entered in applications. These files may be activated only with consent, expressed by clicking the relevant checkbox, which can be withdrawn at any time.

    Please note that if consent for certain cookies is not given, it may not be possible to fully use some elements of the website. It is therefore necessary to configure all browsers on different devices (tablets, smartphones, computers).

  6. Contact

    The user may contact the Administrator via email: kontakt@sigmapets.pl. By doing so, the user provides the Administrator in particular with such data as first name and surname, and email address. Other personal data may be provided to the Administrator on an optional basis. 

    The legal basis for the processing of personal data in such a case is the user’s consent resulting from initiating contact with the Administrator. Personal data sent as part of email correspondence are processed solely for the purpose of handling the enquiry. Correspondence is stored on the mailbox server and may be archived.

  7. Changes to the Policy 

    In order to ensure that the Policy at all times complies with the current legal requirements, the Administrator reserves the right to amend it at any time. The above also applies in cases where the Policy needs to be amended in order to cover new or modified products or services offered via the website.
